關于推進環境監測服務社會化的指導意見
各(ge)省、自治區、直轄市環境保護廳(ting)(局(ju)(ju)),新疆生(sheng)產建設兵團環境保護局(ju)(ju),解(jie)放(fang)軍環境保護局(ju)(ju),遼河(he)保護區管(guan)理局(ju)(ju):
為(wei)全面深化生態文明體制改革,根據《環(huan)(huan)(huan)境(jing)保(bao)護法》和(he)國(guo)(guo)務(wu)院(yuan)辦公廳(ting)《關于政府向社(she)(she)會(hui)(hui)力(li)量購買服務(wu)的指導意(yi)(yi)見》(國(guo)(guo)辦發(fa)〔2013〕96號)精神(shen),引導社(she)(she)會(hui)(hui)力(li)量廣泛參與環(huan)(huan)(huan)境(jing)監測(ce),規范社(she)(she)會(hui)(hui)環(huan)(huan)(huan)境(jing)監測(ce)機(ji)構行(xing)為(wei),促(cu)進環(huan)(huan)(huan)境(jing)監測(ce)服務(wu)社(she)(she)會(hui)(hui)化良性發(fa)展,現提出以下意(yi)(yi)見:
一(yi)、充分認(ren)識推進(jin)環境監測服(fu)務社會化的重(zhong)要意義
(一(yi)(yi))環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)服(fu)務(wu)(wu)(wu)社(she)(she)(she)會(hui)(hui)(hui)(hui)化是環(huan)(huan)(huan)(huan)(huan)保體(ti)(ti)制(zhi)機(ji)(ji)(ji)(ji)制(zhi)改革(ge)創新的重要內容。長期以(yi)來,我國實行的是由(you)政(zheng)府有(you)關部門所屬環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)機(ji)(ji)(ji)(ji)構(gou)為主開(kai)展(zhan)監(jian)(jian)(jian)測(ce)(ce)活(huo)動的單(dan)一(yi)(yi)管(guan)(guan)理體(ti)(ti)制(zhi)。在環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)保護(hu)(hu)領域(yu)日益擴大、環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)任務(wu)(wu)(wu)快(kuai)速增加和環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)管(guan)(guan)理要求不斷提高的情況下,推進(jin)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)服(fu)務(wu)(wu)(wu)社(she)(she)(she)會(hui)(hui)(hui)(hui)化已迫在眉睫。一(yi)(yi)些地(di)方已經開(kai)展(zhan)了實踐探索,出臺(tai)了相(xiang)應的管(guan)(guan)理辦法,許多(duo)社(she)(she)(she)會(hui)(hui)(hui)(hui)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)機(ji)(ji)(ji)(ji)構(gou)已經進(jin)入環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)服(fu)務(wu)(wu)(wu)市場。環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)服(fu)務(wu)(wu)(wu)的社(she)(she)(she)會(hui)(hui)(hui)(hui)化既是加快(kuai)政(zheng)府環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)保護(hu)(hu)職能轉變、提高公共服(fu)務(wu)(wu)(wu)質量和效率的必然要求,也是理順環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)保護(hu)(hu)體(ti)(ti)制(zhi)機(ji)(ji)(ji)(ji)制(zhi)、探索環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)保護(hu)(hu)新路(lu)的現實需要。引導社(she)(she)(she)會(hui)(hui)(hui)(hui)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)機(ji)(ji)(ji)(ji)構(gou)進(jin)入環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)的主戰場,提升政(zheng)府購(gou)買(mai)社(she)(she)(she)會(hui)(hui)(hui)(hui)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)服(fu)務(wu)(wu)(wu)水平,有(you)利(li)于整合社(she)(she)(she)會(hui)(hui)(hui)(hui)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)資(zi)源,激發社(she)(she)(she)會(hui)(hui)(hui)(hui)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)機(ji)(ji)(ji)(ji)構(gou)活(huo)力,形成環(huan)(huan)(huan)(huan)(huan)保系(xi)統環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)機(ji)(ji)(ji)(ji)構(gou)和社(she)(she)(she)會(hui)(hui)(hui)(hui)環(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)機(ji)(ji)(ji)(ji)構(gou)共同(tong)發展(zhan)的新格局。
二、指導思(si)想與基本(ben)原則(ze)
(二(er))指(zhi)導(dao)思想。以(yi)(yi)黨的(de)十八(ba)大和(he)十八(ba)屆(jie)三中、四(si)中全會精神為(wei)指(zhi)導(dao),強化政府環境監(jian)(jian)測(ce)(ce)(ce)(ce)公共(gong)(gong)(gong)服務(wu)(wu)職(zhi)能,加(jia)快轉變環境監(jian)(jian)測(ce)(ce)(ce)(ce)職(zhi)能,推進(jin)政事(shi)分開和(he)政社分開,鼓勵引導(dao)社會環境監(jian)(jian)測(ce)(ce)(ce)(ce)力量廣(guang)泛參(can)與,創新環境監(jian)(jian)測(ce)(ce)(ce)(ce)公共(gong)(gong)(gong)服務(wu)(wu)供(gong)給模式,強化環境監(jian)(jian)測(ce)(ce)(ce)(ce)事(shi)中事(shi)后監(jian)(jian)管,形(xing)成以(yi)(yi)環保系統環境監(jian)(jian)測(ce)(ce)(ce)(ce)機構為(wei)骨干、社會環境監(jian)(jian)測(ce)(ce)(ce)(ce)力量共(gong)(gong)(gong)同(tong)參(can)與的(de)環境監(jian)(jian)測(ce)(ce)(ce)(ce)管理新體制。
(三)基本原則
——積極(ji)引(yin)導。堅持(chi)從實際出發,放寬準入條件,充分(fen)發揮政(zheng)府的主導作用(yong)和市場在資源配置(zhi)中(zhong)的決定(ding)性作用(yong),激(ji)勵社會(hui)環境(jing)監(jian)測機構提供監(jian)測服務供給。
——加快培育(yu)(yu)。積極培育(yu)(yu)環境監(jian)測服(fu)務(wu)市場(chang),營造公平(ping)競爭(zheng)的市場(chang)環境,有序放開(kai)環境監(jian)測服(fu)務(wu)業(ye)務(wu)領域,推動(dong)環境監(jian)測服(fu)務(wu)社會化(hua)工作穩(wen)步開(kai)展(zhan)。
——規(gui)范管理。建立完善環境監(jian)(jian)測服務(wu)(wu)社會化(hua)管理規(gui)章制度,約束環境監(jian)(jian)測服務(wu)(wu)行(xing)為,促進(jin)社會環境監(jian)(jian)測機構不斷提高環境監(jian)(jian)測質量(liang)和管理水平。
——依法監(jian)(jian)督。強化環(huan)境監(jian)(jian)測(ce)行為的(de)事中、事后(hou)監(jian)(jian)管(guan),實(shi)施對(dui)社會環(huan)境監(jian)(jian)測(ce)機構及其(qi)監(jian)(jian)測(ce)服(fu)務行為的(de)監(jian)(jian)督管(guan)理,建立正(zheng)常的(de)退(tui)出機制,維護環(huan)境監(jian)(jian)測(ce)服(fu)務市場(chang)的(de)正(zheng)常秩序。
三、開放環境監(jian)測服務市場
(四)全面放(fang)開服(fu)務(wu)(wu)性監測市場。凡適(shi)合社(she)(she)會力量承擔(dan)的服(fu)務(wu)(wu)性環境(jing)監測業務(wu)(wu),要創造(zao)條件,全面放(fang)開。鼓(gu)勵社(she)(she)會環境(jing)監測機(ji)構參與排污(wu)單位(wei)污(wu)染源自(zi)行監測、環境(jing)損害評估監測、環境(jing)影響評價現狀監測、清潔生產審核、企事業單位(wei)自(zi)主(zhu)調查等(deng)環境(jing)監測活動,推(tui)進環境(jing)監測服(fu)務(wu)(wu)主(zhu)體多元化(hua)和服(fu)務(wu)(wu)方式多樣化(hua)。
(五)有(you)序放開公益性、監(jian)(jian)(jian)督(du)性監(jian)(jian)(jian)測(ce)(ce)領域。各級環(huan)(huan)境(jing)(jing)保(bao)護行(xing)政(zheng)(zheng)(zheng)主管(guan)部門所屬(shu)環(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)機(ji)構(gou)應認真做好所承擔的政(zheng)(zheng)(zheng)府(fu)監(jian)(jian)(jian)測(ce)(ce)職能(neng),包(bao)括(kuo)環(huan)(huan)境(jing)(jing)質量(liang)監(jian)(jian)(jian)測(ce)(ce)、預報(bao)預警、跨(kua)境(jing)(jing)水體(ti)(ti)(ti)監(jian)(jian)(jian)測(ce)(ce)、履約監(jian)(jian)(jian)測(ce)(ce)、污染源(yuan)監(jian)(jian)(jian)督(du)性監(jian)(jian)(jian)測(ce)(ce)、突(tu)發環(huan)(huan)境(jing)(jing)事件應急監(jian)(jian)(jian)測(ce)(ce),以(yi)及環(huan)(huan)境(jing)(jing)執法、環(huan)(huan)境(jing)(jing)質量(liang)目標責(ze)任考(kao)核、排污費征收、總(zong)(zong)量(liang)核算(suan)等環(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)管(guan)中的監(jian)(jian)(jian)測(ce)(ce)工作。同時,可(ke)以(yi)根據財(cai)政(zheng)(zheng)(zheng)部、民政(zheng)(zheng)(zheng)部和(he)工商總(zong)(zong)局關于政(zheng)(zheng)(zheng)府(fu)購買服(fu)務(wu)的總(zong)(zong)體(ti)(ti)(ti)要(yao)求,將(jiang)社會環(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)機(ji)構(gou)能(neng)夠承擔,又不影(ying)響(xiang)公平公正原(yuan)則的相關業務(wu),積極(ji)穩(wen)妥、因地(di)制宜地(di)向社會環(huan)(huan)境(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)機(ji)構(gou)有(you)序放開,包(bao)括(kuo)環(huan)(huan)境(jing)(jing)質量(liang)自(zi)動(dong)(dong)監(jian)(jian)(jian)測(ce)(ce)站(zhan)和(he)污染源(yuan)自(zi)動(dong)(dong)監(jian)(jian)(jian)測(ce)(ce)設施的運行(xing)維護、固體(ti)(ti)(ti)廢(fei)物和(he)危(wei)險廢(fei)物鑒別等監(jian)(jian)(jian)(檢)測(ce)(ce)業務(wu)。
四(si)、扶持(chi)和規范社(she)會(hui)環境監測機構發展
(六)轉變管(guan)(guan)(guan)理方式(shi)。凡適合社(she)會(hui)力量承(cheng)擔(dan)的,環(huan)境(jing)保護行(xing)政(zheng)(zheng)主管(guan)(guan)(guan)部門均可(ke)依據(ju)本行(xing)政(zheng)(zheng)區(qu)實際,選擇采取委托(tuo)、承(cheng)包、采購、名錄管(guan)(guan)(guan)理等方式(shi)交(jiao)由社(she)會(hui)力量承(cheng)擔(dan)。同(tong)時,要加(jia)強對(dui)社(she)會(hui)環(huan)境(jing)監測(ce)機(ji)構事中和事后監管(guan)(guan)(guan),會(hui)同(tong)相(xiang)關(guan)部門共同(tong)出臺相(xiang)關(guan)管(guan)(guan)(guan)理政(zheng)(zheng)策和辦法,推(tui)動環(huan)境(jing)監測(ce)服務社(she)會(hui)化工作的制度化、體系化、規范化。
(七)扶持行(xing)業(ye)發(fa)展。要充分發(fa)揮(hui)環(huan)境(jing)(jing)監(jian)測(ce)行(xing)業(ye)協會(hui)(hui)或第三(san)方機構(gou)的作用,強化社(she)會(hui)(hui)環(huan)境(jing)(jing)監(jian)測(ce)機構(gou)的行(xing)業(ye)管理,簽(qian)訂質(zhi)量保(bao)證承諾,推動行(xing)業(ye)自律。組織開(kai)展社(she)會(hui)(hui)環(huan)境(jing)(jing)監(jian)測(ce)技術人員業(ye)務培訓、業(ye)務比武,評估社(she)會(hui)(hui)環(huan)境(jing)(jing)監(jian)測(ce)機構(gou)的業(ye)務水(shui)平(ping),促進環(huan)境(jing)(jing)監(jian)測(ce)服務行(xing)業(ye)水(shui)平(ping)的不斷(duan)提升。
(八(ba))加(jia)強誠(cheng)信(xin)建設(she)。社會(hui)環(huan)(huan)境監測(ce)(ce)機構應對所提(ti)(ti)供(gong)監測(ce)(ce)數據(ju)的真實性(xing)和(he)(he)(he)準(zhun)確性(xing)負(fu)責,建立健全質量保(bao)證和(he)(he)(he)質量控制體系,嚴(yan)格執行(xing)國家和(he)(he)(he)地方的法(fa)律法(fa)規、標準(zhun)和(he)(he)(he)技(ji)術(shu)(shu)規范,規范環(huan)(huan)境監測(ce)(ce)行(xing)為。加(jia)強技(ji)術(shu)(shu)人(ren)員培訓(xun),鼓(gu)勵(li)監測(ce)(ce)技(ji)術(shu)(shu)人(ren)員積極參加(jia)省級及以上(shang)環(huan)(huan)境保(bao)護行(xing)政主管(guan)部門認可的業務培訓(xun)。主動(dong)公開(kai)信(xin)息,自覺接(jie)受(shou)社會(hui)公眾和(he)(he)(he)環(huan)(huan)保(bao)部門監督,提(ti)(ti)高誠(cheng)信(xin)意識和(he)(he)(he)服(fu)務水平(ping)。
五(wu)、依法監督環(huan)境(jing)監測服務行(xing)為(wei)
(九)完善監(jian)(jian)(jian)管機(ji)制。省級環境(jing)保護行(xing)政主(zhu)管部門應(ying)完善日常監(jian)(jian)(jian)督檢查機(ji)制,加強過程監(jian)(jian)(jian)管和信息公開(kai),定(ding)期(qi)和不定(ding)期(qi)地(di)檢查社(she)(she)(she)會環境(jing)監(jian)(jian)(jian)測(ce)(ce)機(ji)構(gou)的(de)(de)監(jian)(jian)(jian)測(ce)(ce)質(zhi)量,公布社(she)(she)(she)會環境(jing)監(jian)(jian)(jian)測(ce)(ce)機(ji)構(gou)概(gai)況(kuang)和環境(jing)監(jian)(jian)(jian)測(ce)(ce)服務行(xing)為(wei)監(jian)(jian)(jian)督檢查結果,建立(li)公示制度和退出機(ji)制。完善社(she)(she)(she)會環境(jing)監(jian)(jian)(jian)測(ce)(ce)服務機(ji)構(gou)信用記錄,社(she)(she)(she)會環境(jing)監(jian)(jian)(jian)測(ce)(ce)機(ji)構(gou)及其法定(ding)代(dai)表(biao)人在環境(jing)監(jian)(jian)(jian)測(ce)(ce)服務活動中(zhong)存在不規范監(jian)(jian)(jian)測(ce)(ce)行(xing)為(wei)的(de)(de),環境(jing)保護行(xing)政主(zhu)管部門應(ying)將相應(ying)機(ji)構(gou)、法人、監(jian)(jian)(jian)測(ce)(ce)技(ji)術人員的(de)(de)違法信息記入社(she)(she)(she)會誠信檔案,并及時向社(she)(she)(she)會公布。
(十(shi))強化(hua)責任(ren)(ren)追(zhui)究。社會環境(jing)監測(ce)機構在有(you)關環境(jing)服務活動(dong)中弄(nong)虛(xu)作(zuo)假,對(dui)造(zao)成的(de)環境(jing)污染和(he)生(sheng)態破壞負有(you)責任(ren)(ren)的(de),除依(yi)(yi)照有(you)關法律(lv)法規(gui)規(gui)定(ding)予以處(chu)罰外(wai),還應當與(yu)造(zao)成環境(jing)污染和(he)生(sheng)態破壞的(de)其他責任(ren)(ren)者承(cheng)擔連帶責任(ren)(ren)。對(dui)不符合監測(ce)規(gui)范(fan)、監測(ce)結(jie)果有(you)誤的(de),給予通報批評,限期整改;對(dui)于存在弄(nong)虛(xu)作(zuo)假行為的(de)或篡改偽造(zao)監測(ce)數據(ju)的(de),依(yi)(yi)法予以處(chu)罰,并列(lie)入黑名(ming)單,抄送(song)質(zhi)量技術監督主管部門;構成犯罪的(de),依(yi)(yi)法追(zhui)究刑事責任(ren)(ren)。
