關于推進環境監測服務社會化的指導意見
各省、自治區、直轄市環(huan)(huan)境保(bao)護廳(局(ju)),新疆生產建設兵團環(huan)(huan)境保(bao)護局(ju),解放軍環(huan)(huan)境保(bao)護局(ju),遼河保(bao)護區管理局(ju):
為全面深化(hua)(hua)生態文明體制改(gai)革,根據(ju)《環境(jing)(jing)保護(hu)法》和國(guo)務(wu)院辦公廳(ting)《關于政府向(xiang)社會力(li)量(liang)購買服務(wu)的指導意見(jian)》(國(guo)辦發〔2013〕96號)精神(shen),引導社會力(li)量(liang)廣泛參與環境(jing)(jing)監(jian)測,規范社會環境(jing)(jing)監(jian)測機構行為,促(cu)進(jin)環境(jing)(jing)監(jian)測服務(wu)社會化(hua)(hua)良性(xing)發展,現提(ti)出以下意見(jian):
一、充分認識推進環(huan)境監測服務社會化的重要(yao)意義(yi)
(一(yi)(yi))環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)務(wu)(wu)社(she)(she)(she)會(hui)化(hua)(hua)是環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)保(bao)體制(zhi)(zhi)(zhi)機(ji)制(zhi)(zhi)(zhi)改(gai)革創新(xin)的(de)(de)(de)重(zhong)要(yao)(yao)內容。長(chang)期以(yi)來,我國實行的(de)(de)(de)是由政(zheng)府有(you)關部門(men)所屬環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)(gou)為主開(kai)(kai)展監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)活動的(de)(de)(de)單一(yi)(yi)管(guan)理體制(zhi)(zhi)(zhi)。在環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)保(bao)護領域日益(yi)擴大(da)、環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)任(ren)務(wu)(wu)快(kuai)速增加和環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)管(guan)理要(yao)(yao)求不斷(duan)提高的(de)(de)(de)情況下,推進(jin)(jin)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)務(wu)(wu)社(she)(she)(she)會(hui)化(hua)(hua)已迫在眉睫。一(yi)(yi)些地方已經開(kai)(kai)展了實踐探(tan)(tan)索(suo),出臺了相(xiang)應的(de)(de)(de)管(guan)理辦法,許多社(she)(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)(gou)已經進(jin)(jin)入(ru)(ru)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)務(wu)(wu)市場(chang)。環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)務(wu)(wu)的(de)(de)(de)社(she)(she)(she)會(hui)化(hua)(hua)既(ji)是加快(kuai)政(zheng)府環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)保(bao)護職能轉變(bian)、提高公共服(fu)務(wu)(wu)質(zhi)量和效率(lv)的(de)(de)(de)必然要(yao)(yao)求,也(ye)是理順環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)保(bao)護體制(zhi)(zhi)(zhi)機(ji)制(zhi)(zhi)(zhi)、探(tan)(tan)索(suo)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)保(bao)護新(xin)路(lu)的(de)(de)(de)現實需要(yao)(yao)。引導社(she)(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)(gou)進(jin)(jin)入(ru)(ru)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)的(de)(de)(de)主戰場(chang),提升(sheng)政(zheng)府購買社(she)(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)服(fu)務(wu)(wu)水平,有(you)利于整合社(she)(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)資源,激(ji)發社(she)(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)(gou)活力,形(xing)成環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)保(bao)系(xi)統環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)(gou)和社(she)(she)(she)會(hui)環(huan)(huan)(huan)(huan)(huan)(huan)(huan)(huan)境(jing)(jing)(jing)(jing)(jing)(jing)(jing)監(jian)(jian)(jian)(jian)測(ce)(ce)(ce)(ce)(ce)機(ji)構(gou)(gou)共同(tong)發展的(de)(de)(de)新(xin)格局。
二、指導思想與基本原則(ze)
(二)指導(dao)思想。以黨的十八大和(he)十八屆(jie)三中(zhong)(zhong)、四中(zhong)(zhong)全會(hui)精神為指導(dao),強化(hua)政(zheng)府環(huan)(huan)境(jing)(jing)(jing)監(jian)測公(gong)(gong)共服(fu)務(wu)職(zhi)能,加(jia)快轉變環(huan)(huan)境(jing)(jing)(jing)監(jian)測職(zhi)能,推進政(zheng)事分(fen)開和(he)政(zheng)社(she)分(fen)開,鼓勵引導(dao)社(she)會(hui)環(huan)(huan)境(jing)(jing)(jing)監(jian)測力量(liang)廣泛參(can)與,創新環(huan)(huan)境(jing)(jing)(jing)監(jian)測公(gong)(gong)共服(fu)務(wu)供給模式,強化(hua)環(huan)(huan)境(jing)(jing)(jing)監(jian)測事中(zhong)(zhong)事后監(jian)管,形成以環(huan)(huan)保(bao)系統環(huan)(huan)境(jing)(jing)(jing)監(jian)測機構為骨干、社(she)會(hui)環(huan)(huan)境(jing)(jing)(jing)監(jian)測力量(liang)共同參(can)與的環(huan)(huan)境(jing)(jing)(jing)監(jian)測管理(li)新體(ti)制。
(三)基本原則(ze)
——積極引(yin)導(dao)(dao)。堅(jian)持(chi)從實(shi)際(ji)出發(fa),放寬準入條件,充分(fen)發(fa)揮政府的主導(dao)(dao)作(zuo)用(yong)和(he)市場在資源配置(zhi)中的決定性(xing)作(zuo)用(yong),激勵社會(hui)環境監測(ce)(ce)機構提供(gong)監測(ce)(ce)服務供(gong)給。
——加快(kuai)培育(yu)(yu)。積極培育(yu)(yu)環境監測服務(wu)市場,營(ying)造公平競爭的市場環境,有序放(fang)開環境監測服務(wu)業務(wu)領域,推動(dong)環境監測服務(wu)社會(hui)化(hua)工作(zuo)穩步開展。
——規范管理(li)。建(jian)立完善環境(jing)(jing)監測(ce)(ce)服務社會(hui)化(hua)管理(li)規章制度(du),約束環境(jing)(jing)監測(ce)(ce)服務行(xing)為(wei),促進社會(hui)環境(jing)(jing)監測(ce)(ce)機構(gou)不(bu)斷(duan)提高環境(jing)(jing)監測(ce)(ce)質(zhi)量和管理(li)水平。
——依(yi)法監(jian)(jian)督。強化環境監(jian)(jian)測(ce)行為的(de)事(shi)中、事(shi)后監(jian)(jian)管,實(shi)施對社(she)會環境監(jian)(jian)測(ce)機構及其監(jian)(jian)測(ce)服務(wu)行為的(de)監(jian)(jian)督管理,建立正常的(de)退(tui)出機制,維護環境監(jian)(jian)測(ce)服務(wu)市場(chang)的(de)正常秩(zhi)序。
三、開放環境監(jian)測服務市場
(四)全(quan)面(mian)放開服(fu)務性(xing)監(jian)測(ce)(ce)市場。凡(fan)適合社(she)會(hui)力(li)量承擔的服(fu)務性(xing)環境(jing)(jing)(jing)監(jian)測(ce)(ce)業務,要創造條件(jian),全(quan)面(mian)放開。鼓勵(li)社(she)會(hui)環境(jing)(jing)(jing)監(jian)測(ce)(ce)機構(gou)參與排(pai)污單位污染源自行監(jian)測(ce)(ce)、環境(jing)(jing)(jing)損害評(ping)估監(jian)測(ce)(ce)、環境(jing)(jing)(jing)影響評(ping)價現狀(zhuang)監(jian)測(ce)(ce)、清潔生產(chan)審核、企事(shi)業單位自主調查(cha)等環境(jing)(jing)(jing)監(jian)測(ce)(ce)活動,推進環境(jing)(jing)(jing)監(jian)測(ce)(ce)服(fu)務主體多元化(hua)和服(fu)務方(fang)式多樣化(hua)。
(五)有(you)序(xu)放開公(gong)益性(xing)、監(jian)(jian)(jian)督性(xing)監(jian)(jian)(jian)測(ce)(ce)(ce)領(ling)域(yu)。各級(ji)環(huan)境(jing)(jing)(jing)保護(hu)(hu)行政(zheng)主管部(bu)門所屬環(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)構應認真做好所承擔的政(zheng)府監(jian)(jian)(jian)測(ce)(ce)(ce)職能(neng),包(bao)括(kuo)環(huan)境(jing)(jing)(jing)質(zhi)量(liang)監(jian)(jian)(jian)測(ce)(ce)(ce)、預(yu)報預(yu)警、跨境(jing)(jing)(jing)水體(ti)監(jian)(jian)(jian)測(ce)(ce)(ce)、履約監(jian)(jian)(jian)測(ce)(ce)(ce)、污染(ran)源(yuan)監(jian)(jian)(jian)督性(xing)監(jian)(jian)(jian)測(ce)(ce)(ce)、突發(fa)環(huan)境(jing)(jing)(jing)事件應急監(jian)(jian)(jian)測(ce)(ce)(ce),以(yi)及環(huan)境(jing)(jing)(jing)執法(fa)、環(huan)境(jing)(jing)(jing)質(zhi)量(liang)目標責任考核、排(pai)污費征收、總量(liang)核算(suan)等(deng)環(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)管中(zhong)的監(jian)(jian)(jian)測(ce)(ce)(ce)工作。同時,可以(yi)根據財(cai)政(zheng)部(bu)、民(min)政(zheng)部(bu)和(he)工商(shang)總局關(guan)(guan)于政(zheng)府購買服(fu)務的總體(ti)要求,將(jiang)社會環(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)構能(neng)夠承擔,又(you)不影響(xiang)公(gong)平(ping)公(gong)正(zheng)原則的相(xiang)關(guan)(guan)業務,積極穩妥(tuo)、因(yin)地制宜地向(xiang)社會環(huan)境(jing)(jing)(jing)監(jian)(jian)(jian)測(ce)(ce)(ce)機(ji)構有(you)序(xu)放開,包(bao)括(kuo)環(huan)境(jing)(jing)(jing)質(zhi)量(liang)自動監(jian)(jian)(jian)測(ce)(ce)(ce)站(zhan)和(he)污染(ran)源(yuan)自動監(jian)(jian)(jian)測(ce)(ce)(ce)設施(shi)的運行維護(hu)(hu)、固體(ti)廢物和(he)危險廢物鑒別等(deng)監(jian)(jian)(jian)(檢(jian))測(ce)(ce)(ce)業務。
四、扶持和規范(fan)社會環境監測機構(gou)發展(zhan)
(六)轉變管(guan)理(li)方式。凡適合(he)社(she)會力量承擔的(de),環境(jing)保護行政(zheng)主管(guan)部門(men)均可依據本行政(zheng)區(qu)實際,選擇采取委托、承包、采購(gou)、名錄管(guan)理(li)等(deng)方式交由社(she)會力量承擔。同時,要加強對社(she)會環境(jing)監(jian)測(ce)機構事(shi)中和事(shi)后監(jian)管(guan),會同相關部門(men)共同出臺(tai)相關管(guan)理(li)政(zheng)策(ce)和辦法,推(tui)動環境(jing)監(jian)測(ce)服務社(she)會化(hua)工作的(de)制度化(hua)、體系化(hua)、規范化(hua)。
(七)扶持行(xing)業(ye)(ye)(ye)發展。要充分(fen)發揮環(huan)(huan)境監(jian)(jian)(jian)測(ce)行(xing)業(ye)(ye)(ye)協會或第三方機構(gou)(gou)的作用,強化(hua)社(she)會環(huan)(huan)境監(jian)(jian)(jian)測(ce)機構(gou)(gou)的行(xing)業(ye)(ye)(ye)管理,簽訂(ding)質量(liang)保證承諾(nuo),推動行(xing)業(ye)(ye)(ye)自(zi)律。組織(zhi)開展社(she)會環(huan)(huan)境監(jian)(jian)(jian)測(ce)技(ji)術人(ren)員業(ye)(ye)(ye)務培(pei)訓、業(ye)(ye)(ye)務比武,評估社(she)會環(huan)(huan)境監(jian)(jian)(jian)測(ce)機構(gou)(gou)的業(ye)(ye)(ye)務水(shui)平,促進環(huan)(huan)境監(jian)(jian)(jian)測(ce)服(fu)務行(xing)業(ye)(ye)(ye)水(shui)平的不斷提升。
(八)加強誠(cheng)信(xin)(xin)(xin)建設(she)。社(she)會環境(jing)監(jian)(jian)(jian)測(ce)機(ji)構應對(dui)所提供監(jian)(jian)(jian)測(ce)數據的真實性(xing)和(he)(he)準確性(xing)負責,建立健全質量(liang)保(bao)證和(he)(he)質量(liang)控制體系,嚴(yan)格執行(xing)(xing)國家和(he)(he)地方的法律法規、標準和(he)(he)技術規范,規范環境(jing)監(jian)(jian)(jian)測(ce)行(xing)(xing)為。加強技術人(ren)員(yuan)培訓,鼓勵監(jian)(jian)(jian)測(ce)技術人(ren)員(yuan)積極參加省級及以上環境(jing)保(bao)護行(xing)(xing)政主管(guan)部(bu)門(men)認可的業務培訓。主動公開信(xin)(xin)(xin)息,自覺接受社(she)會公眾和(he)(he)環保(bao)部(bu)門(men)監(jian)(jian)(jian)督,提高誠(cheng)信(xin)(xin)(xin)意識和(he)(he)服務水(shui)平。
五、依(yi)法監督環境監測服(fu)務行(xing)為(wei)
(九(jiu))完善監(jian)(jian)管機(ji)(ji)制(zhi)。省級環境保護行(xing)政主管部(bu)門應(ying)完善日(ri)常監(jian)(jian)督檢(jian)(jian)查(cha)(cha)機(ji)(ji)制(zhi),加強過程監(jian)(jian)管和信息公(gong)開,定期(qi)和不定期(qi)地檢(jian)(jian)查(cha)(cha)社(she)(she)會(hui)環境監(jian)(jian)測(ce)(ce)(ce)機(ji)(ji)構(gou)的監(jian)(jian)測(ce)(ce)(ce)質量(liang),公(gong)布社(she)(she)會(hui)環境監(jian)(jian)測(ce)(ce)(ce)機(ji)(ji)構(gou)概(gai)況和環境監(jian)(jian)測(ce)(ce)(ce)服務(wu)(wu)行(xing)為監(jian)(jian)督檢(jian)(jian)查(cha)(cha)結(jie)果,建立公(gong)示制(zhi)度(du)和退出機(ji)(ji)制(zhi)。完善社(she)(she)會(hui)環境監(jian)(jian)測(ce)(ce)(ce)服務(wu)(wu)機(ji)(ji)構(gou)信用記錄,社(she)(she)會(hui)環境監(jian)(jian)測(ce)(ce)(ce)機(ji)(ji)構(gou)及其法定代表(biao)人(ren)在環境監(jian)(jian)測(ce)(ce)(ce)服務(wu)(wu)活動中存在不規范監(jian)(jian)測(ce)(ce)(ce)行(xing)為的,環境保護行(xing)政主管部(bu)門應(ying)將相應(ying)機(ji)(ji)構(gou)、法人(ren)、監(jian)(jian)測(ce)(ce)(ce)技術(shu)人(ren)員的違法信息記入社(she)(she)會(hui)誠信檔案,并及時向社(she)(she)會(hui)公(gong)布。
(十)強化責(ze)任(ren)(ren)追究。社會環(huan)(huan)境(jing)(jing)監(jian)測(ce)機(ji)構在有關環(huan)(huan)境(jing)(jing)服務活(huo)動中弄(nong)虛作假(jia),對造(zao)成的(de)環(huan)(huan)境(jing)(jing)污染和(he)生態破(po)壞負有責(ze)任(ren)(ren)的(de),除依(yi)照有關法(fa)律法(fa)規規定予以(yi)處罰外(wai),還(huan)應(ying)當與(yu)造(zao)成環(huan)(huan)境(jing)(jing)污染和(he)生態破(po)壞的(de)其(qi)他責(ze)任(ren)(ren)者承擔(dan)連(lian)帶責(ze)任(ren)(ren)。對不符合監(jian)測(ce)規范、監(jian)測(ce)結果(guo)有誤的(de),給(gei)予通報批評,限期整(zheng)改;對于存在弄(nong)虛作假(jia)行為的(de)或篡改偽造(zao)監(jian)測(ce)數據的(de),依(yi)法(fa)予以(yi)處罰,并列入黑(hei)名單,抄送質量(liang)技術(shu)監(jian)督主管部門(men);構成犯罪(zui)的(de),依(yi)法(fa)追究刑事責(ze)任(ren)(ren)。
